All items purchased from Water Filters Online are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

However, Water Filters Online does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Water Filters Online itself is not as described, your sole remedy is to return it in unused condition.

DEFECTS

You must inspect the Products on the date of delivery and notify us of any alleged
defect or damage or incorrect products or quantity (Defects). Upon request, you
must allow us to inspect, or return to us, any defective or damaged Products.
You should notify us of any alleged Defects as soon as possible to enable us to
confirm that any Defects occurred before delivery to you.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

CGA - Consumer Guarantees Act
If you are acquiring, or hold yourself out as acquiring, any Products or Services in trade, to the extent permitted by law, you agree that the parties are contracting out of the CGA (to the extent that the CGA would otherwise apply) and that the CGA does not apply to any matters covered by these Terms.

If you are acquiring any Products for the purpose of resupply in trade, you undertake that you will:
(a) contract out of the CGA to the maximum extent permitted by law in your contracts with your own customers; and
(b) procure that your customers, and each other person in the distribution chain thereafter, contract out of the CGA to the maximum extent permitted by law in their contracts with customers.
You will indemnify us against any liability or cost incurred by us as a result of your breach of this clause. 

WAR - Warranties
These Terms are meant to be read in conjunction with any other Warranty Statement posted on our website. If there are any inconsistencies between two documents, then the Terms contained in this document shall prevail.
We warrant that all Products and Services are free from material defects in materials and workmanship. However, this warranty will not cover any defect or damage to the extent that it is caused by:
(a) any fault or defect in our Products or Services resulting from any of your (or your Representatives) acts or omissions (outside of the ordinary use of the Products or Services); or
(b) minor deviations in specification, measurements, colour, weight, size or strength of the Products.

LL - Limitation of Liability 

To the maximum extent permitted by New Zealand law, Water Filters Online and its affiliates, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use, or inability to use, the water treatment equipment purchased through this website.

All products are sold "as is" and "where is." While we aim to provide accurate information, Water Filters Online makes no warranties, express or implied, regarding the fitness, merchantability, or suitability of any product for a particular purpose.

Our total liability for any claim, damages, or loss related to this website or products shall not exceed the greater of the purchase price paid by you for the product.

This limitation of liability applies regardless of whether the damages are based on warranty, contract, tort, or any other legal theory and even if we have been advised of the possibility of such damages.

APPLICABLE LAW

By visiting Water Filters Online, you agree that the laws of New Zealand, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Water Filters Online or its affiliates.

ELECTRONIC COMMUNICATIONS

When you visit Water Filters Online or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

DISPUTES

Any dispute relating in any way to your visit to Water Filters Online or to products you purchase through Water Filters Online shall be submitted to confidential arbitration in New Zealand, except that, to the extent you have in any manner violated or threatened to violate Water Filters Online’s intellectual property rights, Water Filters Online may seek injunctive or other appropriate relief in any court in New Zealand, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of an independent arbitrator. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

UNPAID ORDERS

Order must be paid within three (3) working days.

If payment is not received within this period, the order will be considered unconfirmed, and we reserve the right to cancel the order and/or revalidate the pricing before the order can be processed.

BILLING & SHIPPING

All prices are in NZD and include 15% GST. We will only send to NZ Based addresses recognised by NZ Post (no overseas addresses).
